The Monroe County Prosecutor offers an Infraction Diversion
Program (IDP) to eligible drivers who are charged with
certain traffic offenses. When a driver successfully
completes this program, the traffic ticket is dismissed and
no conviction or points for that ticket will appear on the
driver's record. Failure to successfully complete the
program, however, will result in the ticket being redocketed
and prosecuted (note also that no refund of IDP fees are
made for any reason).
IDP Eligibility
A driver must meet all of the requirements listed below:
- no more than three convictions for moving
traffic violations in the past five years;
- no convictions for any major moving violations, such as
Operating While Intoxicated, Reckless Driving, or Leaving the
Scene of an Accident; unless agreed to by the trial deputy.
- no convictions for 8 point offenses such as Driving
While Suspended Prior, Failure to Yield to an Emergency
Vehicle, or Speed Contest; unless agreed to by the trial
deputy.
- the current charge is for a moving traffic violation other
than speeding 25+ mph over the limit, any offense involving
an accident, passing
a school bus when loading or unloading, failing to yield to an emergency
vehicle, or any other eight-point
offense (as designated an by the Indiana Bureau of Motor
Vehicles).
- hold a valid operator's license; CDL licenses are not
eligible.
Eligibility is at the complete discretion of the Monroe
County Prosecutor and his representatives - any driver may
be made ineligible for any reason by the Monroe County
Prosecuting Attorney.If you feel that you have met the
requirements of Infraction Diversion, a copy of the
agreement for valid INDIANA
driver's licenses may be obtained
here.
If you hold a valid driver's license from a state
OTHER THAN INDIANA (no
international licenses), a copy of the
out-of-state agreement may be obtained
here (please note
that this is the only agreement that will be accepted for
out-of-state licenses). Complete the agreement,
include a cashier's check or money order for $191.50,), and mail the
agreement and payment to the Monroe
County Clerk at the address on the agreement.
* To obtain your CAUSE NUMBER for filling out your IDP
form or paying online, click
HERE. Use the dropdown menu to select "Monroe
County." Click "Criminal & Citation Case Records." Then
select "Defendant" from the dropdown and search for yourself
by using your name.
It could take up to two weeks for your ticket to get
filed. Please allow this much time
before calling for assistance.

Terms of the Program
Once it has been determined that a driver is eligible for
IDP, he or she must:
- sign and return the IDP agreement form to the Monroe County
Clerk by the designated due date; receipts are not
automatically sent out, if you would like a receipt,
include a self-addressed stamped envelope with your
payment.
- pay the Monroe County Clerk program fees totaling $191.50
(in cash or certified check or money order, payable to the
Monroe County Clerk) at the time the Agreement is
signed/returned. This $191.50 fee includes the
cost of your ticket, and is not in addition to the
original fine.
- not be charged with any moving traffic violations for a
period of six months from the date of the IDP agreement; and
- notify IDP of any address change during the six month
period.
- IMPORTANT: There
are no classes required for the Infraction Diversion
program. However, the BMV may require you to take a defensive
driving course if you have had two or more moving
violations within the last 12 months; please contact them
